These Terms of Service govern your use of NativeExpress and any related services provided by NativeExpress.

By accessing NativeExpress, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by NativeExpress.

We, NativeExpress, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Relationship to the License Terms

If you have purchased a product from NativeExpress, the scope of your rights to use the materials delivered with that purchase (the source code, the Notion template, the Figma template, and any other materials supplied as part of the purchase) is governed by our License Terms.

In the event of any conflict or inconsistency between these Terms of Service and the License Terms as to what you are permitted to do with those materials, the License Terms prevail and govern. Nothing in these Terms of Service limits, qualifies, or revokes any right granted to you by the License Terms, including the right to use the materials commercially, to use them in client work, and to create an unlimited number of end products.

For the avoidance of doubt, the License Terms prevail only in respect of the scope of the license granted to you. The Liability, Accuracy of Materials, Right to Terminate, Severance, and Governing Law sections of these Terms of Service continue to apply in full to the purchased materials and to any dispute arising out of them.

These Terms of Service govern your use of the NativeExpress website and related services generally.

Limitations of Use

The restrictions in this section apply to this website and its associated services. They do not apply to materials you have licensed from us under the License Terms; what you are permitted to do with those materials is governed by the License Terms, which expressly permit modification, commercial use, and use in client projects.

Subject to that, by using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • Modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website
  • Remove any copyright or other proprietary notations from any materials and software on this website
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service NativeExpress provides
  • Use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to NativeExpress and are protected by applicable copyright and trademark law.

Website content. In respect of this website's own content (marketing pages, blog posts, and other materials made available to visitors generally), we grant our users permission to download one copy of the materials for personal, non-commercial transitory use. This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by NativeExpress at any time.

Purchased materials. The paragraph above does not apply to the source code, Notion template, Figma template, or any other materials delivered to you as part of a NativeExpress purchase. Those materials are licensed to you under the License Terms, which grant an ongoing, non-exclusive, worldwide license to use them commercially, in client projects, and to create an unlimited number of end products, subject only to the restrictions set out in the License Terms. The "one copy for personal, non-commercial transitory use" grant above does not restrict those rights.

Our documentation, including any code samples, configuration, and setup instructions it contains, is provided to support your use of the purchased materials. You may use it on the same terms as those materials, including commercially and in client projects.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, NativeExpress makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall NativeExpress or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if NativeExpress or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, "consequential loss" includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.

This section applies both to the materials on our website and to any materials delivered to you as part of a NativeExpress purchase, including the source code, the Notion template, and the Figma template. Nothing in the License Terms limits or displaces the disclaimers and limitations set out in this section.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. Nothing in these Terms of Service excludes or limits any right you have under mandatory consumer protection law that cannot lawfully be excluded or limited.

Accuracy of Materials

The materials appearing on our website are not comprehensive and are for general information purposes only. NativeExpress does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

NativeExpress has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval, or control by NativeExpress of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

Products and Services

All products and services are delivered by NativeExpress.

Once your payment has been confirmed, access to the source code is granted by adding the GitHub account you provide at checkout as a read-only collaborator on our private GitHub repository. Where your purchase includes the Notion template and the Figma template, links to these are sent by email to the address you provide at checkout, together with an invitation to our Discord community.

You are responsible for providing a valid GitHub username and email address at checkout. Access is tied to the GitHub account you nominate.

Security

NativeExpress does not process any order payments through the website. All payments are processed securely through Stripe, a third-party online payment provider.

Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Germany and the European Union. To the extent legally permissible, the place of jurisdiction is Berlin, Germany. Where you are a consumer, this does not affect any right you have to bring proceedings in the courts of your country of residence under mandatory law. If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect.

Refund Policy

Our products are digital goods delivered electronically. The following terms are based on EU consumer protection laws (Directive 2011/83/EU and Digital Content Directive) as detailed on the official EU Consumer Rights portal (https://europa.eu/youreurope/citizens/consumers/shopping/guarantees-returns/index_en.htm).

Right of Withdrawal

In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal (14-day cooling-off period) does not apply to digital content where:

  1. You have accessed or downloaded the digital content
  2. The performance of the service has begun with your prior express consent
  3. You have acknowledged that you will lose your right of withdrawal upon access or download

By purchasing our products, you expressly consent to immediate access to the digital content and acknowledge the loss of your right of withdrawal.

Digital Content Guarantee

For digital content and services, you have the following rights:

  1. The content/service must:

    • Function as advertised and described
    • Be of reasonable quality and fit for purpose
    • Include necessary updates to maintain functionality

  2. If defects appear:

    • We will provide necessary fixes free of charge
    • If we cannot fix issues within a reasonable timeframe and without significant inconvenience to you, you may be entitled to:
      • A price reduction, or
      • Contract termination and refund

  3. For continuous service delivery (subscriptions):

    • We are responsible for any defects throughout the service period
    • Updates will be provided during the entire subscription period
